'Isle of Man Energy' FAQs (Manx Gas FAQs)

Is it legal that I was not informed of the name change?

It is generally legal for a company to change its trading name without specifically informing each customer. Trading names are not a legally recognised entity, they are essentially 'nicknames' for a company which is legally known by its registered name.

A company can use multiple trading names, and it can change them or add new ones as it wishes. However, it must not mislead customers or use any trading names that could be considered fraudulent or deceptive.

While there is no specific legislation that requires a company to inform customers of a name change, this does not consider fiduciary duties, contract law, or specific industry regulation. Depending upon the nature of the company-customer relationship, it might be necessary to notify customers of the change to prevent confusion or contractual disputes.

Regarding communication to stakeholders such as customers, it is regarded as good practice to inform of changes, to maintain transparency and trust. However, it seems there is no strict legal precedent in place that all companies must follow in the Isle of Man.
